General Terms of Use for Content on mti.hu
I accept the following General Terms of Use:
I. CONCEPTS USED IN THE GENERAL TERMS OF USE
1. CONTENTS
For the purposes of these Terms of Use, "Content" means all text, graphics and still image news material on the website, regardless of its legal quality, downloadability, usability or the manner how it is available exclusively on the website.
2. MTI
The Magyar Távirati Iroda (Hungarian Telegraphic Office) department of Duna Médiaszolgáltató Nonprofit Zrt., as the publisher of the Content.
3. SERVICE PROVIDER
The rights owner of all content on the mti.hu website is the Media Service Support and Asset Management Fund (hereinafter: “MTVA”). Duna Médiaszolgáltató Nonprofit Zrt. (hereinafter referred to as “DMSZ”) and MTVA hold all the licences and rights – in particular copyright, economic and other rights related to the published content – under which the Content on mti.hu may be made available to third parties. For the purposes of these Terms of Use, the term “Service Provider” shall mean DMSZ.
4. USER
For the purposes of these Terms of Use, "User" means any person who has registered on the mti.hu website as a natural person or as an authorised representative of a legal entity or a company without legal personality, who has concluded a service contract with MTVA, who has visited the website without registering and who has thereby accepted these Terms of Use.
II. REGISTRATION
1. The use of certain parts of the website is subject to registration. Following registration, the User acquires a non-exclusive right to view, publish, reproduce, process and incorporate into its services the free of charge and freely usable content of MTI, subject to full compliance with the terms and conditions set out in Section 3 of these "General Terms of Use" and its subsections. For the activities of minor Users, their statutory representative shall assume full responsibility.
2. The fact that the User is entitled to use MTI's content published on the mti.hu website on their own platform in a media-like manner is confirmed by the "MTI news user" logo that the User can download from the service provider's interface after registration. The User is entitled and obliged to place the logo on the home page or in the imprint of the User's online interface and in the imprint of the User's print publication. For other electronic media uses, the terms set out in Section III of these General Terms of Use shall prevail.
3. The User may freely scale the logo within the limits of legibility and recognisability, while maintaining its proportions, but may not use it to authenticate other information not originating from MTI, nor may it misuse it or mislead its readers or viewers.
III. USE OF THE CONTENT
MTVA reserves all rights (in particular: intellectual property rights). Use of the Content in any way, publication on other third party platforms is only permitted to Users registered on the mti.hu website and who have concluded a service contract with MTVA, in accordance with the terms and conditions set out in the GTC available at the https://mtva.hu/aszf-az-mtva-tartalomertekesitesi-es-szolgaltatasi-szerzodeseihez/ link. The use of Content from the visitor interface of the mti.hu website by other persons is prohibited, subject to the above.
The Contents are part of the MTI database; the database identifier in MTI's editorial system is given at the beginning of the news. The MTI database or its elements may be used only with the permission of MTVA (under the terms of the subscription contract or individual consent, or, in the case of registered Users, under the terms of these General Terms of Use) or in cases provided by law.
The Service Provider states that if an individual contract has been concluded between MTVA/DMSZ and the User, the specific provisions of the individual contract (subscription, order) shall apply primarily to the legal relationship between them. In the event of a discrepancy between these general terms of use and the provisions of the individual contract on the same subject, the provisions of the individual contract shall prevail.
1. MEDIA USAGE – FOR REGISTERED USERS
The Content on the website may be used within the framework of media information; any other use, in particular promotional or any other use for advertising purposes, or any use in accordance with Sections III.3–III.5 of these General Terms of Use, is not permitted.
The User is entitled to use the Content, to modify, supplement, add explanations to, reproduce and distribute it without changing its essential elements and the facts contained therein, subject to the provisions of these General Terms of Use.
Permitted use is not the same as indiscriminate copying, and the Service Provider expressly prohibits the automatic, indiscriminate copying of the Content, whether by software or otherwise, and the mirroring of the website. The User accepts and acknowledges that the amount of content that may be retransmitted may not exceed eighty (80) percent of the daily average of the given content type – image, text or graphics.
a) SPECIFIC CONDITIONS FOR THE USE OF THE TEXTUAL CONTENT OF THE WEBSITE
The User undertakes
· to process and publish the material received from the Service Provider without distorting its content, without any possibility of misinterpretation or malicious inference, and in a manner that can be integrated into the original context;
· that if the Service Provider issues a correction, error correction, clarification or withdraws a news item in relation to the news item issued, the User shall immediately correct, clarify or validate it in its own material, service or publication platform, which has already been taken over, published or processed, and shall no longer refer to the original news item, not even by reference;
· to assume full liability for any request, complaint or claim for damages from third parties due to failure to correct, clarify or withdraw the news or due to the processing of the news, e.g. change of title, editing, etc., and acknowledges that the Service Provider is not liable in such cases;
· that if the material received from the Service Provider is published with unchanged text or without substantial changes, the User shall indicate MTI as the source, otherwise the User shall refer to the source of the news – e.g. “according to MTI information”, “statement made to MTI”, etc.
· that beyond the scope of lawful use (except in cases of display outside the platform of use), the Content
o will not be stored by the User in whole or in part,
o will not be used by the User to create a database or archives,
· will not be made available by the User.
b) SPECIFIC CONDITIONS FOR THE USE OF STILL CONTENT OF THE WEBSITE
The User undertakes
· to publish the photos taken over from the Service Provider with the indication "MTI photo" and the name of the author;
· to publish the caption of the photo only together with the photo. The User may not independently communicate the text of the news accompanying the image, nor illustrate other news or text with the image, especially if this is in conflict with the original context and message of the image;
· that since the right to use the photographic image(s) is granted for a period of one calendar year from the date of publication by the news agency, the User shall use the photographic image(s) within the prescribed period, shall not transfer them to third parties for further use, shall not create an archive of the photographic image(s) and shall not use them again beyond the thirtieth (30th) calendar day after publication;
· not to alter the content of the photograph(s) and the accompanying text(s) by retouching, cropping, computer interference (e.g. copying) or any other means, and to pay particular attention to the observance of rights relating to personality in the communication.
· to comply fully with the following provisions in respect of MTI graphics:
o MTI graphics shall be published with acknowledgement of the source as indicated thereon.
o The User shall be entitled to use the graphics within one calendar year from the date of publication by the news agency, and may use them within the prescribed period of time, and may not transfer them to third parties for further use,
o The User will not alter or distort the data contained in the graphics, nor will it create new news material from parts of the data that, with full knowledge of the data, contradicts the data or the message of the original news graphic,
o The User shall not archive the graphic(s) and shall not use the graphic(s) beyond the thirtieth (30th) calendar day following the date of publication.
2. PRIVATE USE OR USE FOR EDUCATIONAL PURPOSES IN SCHOOLS
The User shall also be entitled to use the Content for purposes other than the purpose of the media service which is considered free use under the Copyright Act. This includes in particular: copies made by a natural person for private use, and copies for the purpose of school education or scientific research for illustrative purposes, provided that such uses do not exceed the extent justified by the purpose, the source and the author's name are indicated, and the reproductions are not made for profit, even indirectly.
Service Provider also in this context strictly prohibits any direct or indirect use in connection with a news agency service, and therefore does not contribute to the publication of the Content in such a service even if it does not serve the purpose generating income, even indirectly. The Service Provider expressly prohibits the automatic, indiscriminate copying of the Content, whether by software or otherwise.
3. RESTRICTIONS ON USES UNDER SECTION 36(2) OF THE COPYRIGHT ACT
MTVA excludes and prohibits the use of the Content in the case of uses pursuant to Section 36(2) of the Copyright Act, the Content, including in particular articles on current economic or political topics commissioned by or produced by MTVA/DMSZ or within its asset management, or broadcast on such topics, may not be freely reproduced or broadcast to the public in the press – including making it available to the public [Section 26(8)].
4. RESTRICTIONS ON THE USE OF CONTENT FOR DIRECT MARKETING PURPOSES
The Content is made available by the Service Provider free of charge. Therefore, the Service Provider expressly prohibits the User from using the contents of the website to perform any news agency service or any activity similar or identical in nature to such service, including the sale of the Contents in whole or in part and their incorporation into a news agency service.
The Service Provider reserves the right to permanently exclude the User from the service without notice in the event of any violation or suspected violation of these Terms by the User.
5. NO TEXT AND DATA MINING
No text or data mining is allowed for Content usage, so in particular, the reproduction, copying, recycling, adaptation or other use of the Content by or in artificial intelligence systems is not permitted.
It is strictly prohibited to mine, extract or use the Content with any artificial intelligence system, including but not limited to machine learning models, natural language processing algorithms and any other automated data processing systems. AI data scraping, AI data crawling and/or any form of automated data mining is prohibited.
Reproduction, distribution or any other use of the Content for the purpose of training, testing or developing artificial intelligence systems is expressly prohibited.
Any attempt to incorporate the Content into artificial intelligence systems, whether for commercial, scientific, research or any other purpose, is a direct and serious violation of this policy.
IV. USE OF TRADEMARKS AND LOGOS
All logos, trademarks and graphic elements on the website are protected. The Service Provider expressly does not authorise and prohibits the copying, mirroring or use of the graphic elements and trademarks of the website, with the exception of the use of the “MTI news user” logo as described and specified in Section II.2 of these Terms of Use.
V. DATA PROCESSING
The Service Provider undertakes and commits to process all data concerning the User that comes into its possession in compliance with the applicable legal provisions, not to disclose them to third parties and to use them only to the extent indispensable for the operation of the service.
VI. DISCLAIMER
a) The Service Provider will endeavour to maintain the continuity of the service without error, but does not guarantee that the functionality of the website and the service it provides will be free from error.
b) The website and its content are subject to change without notice.
c) The Service Provider will make every effort to ensure that the material on the website is free of viruses and other harmful programs.
d) The Service Provider does not assume any liability for any damage, whether actual or perceived, or for any computer malfunction resulting from the use or inability to use the website. The User uses the website at their own risk.
e) The Service Provider shall not be liable in any way if the content is not available on the User's system due to compatibility or other errors. The Service Provider cannot be held liable for any damage or delay, whether actual or perceived, suffered by the User as a result.
f) The Service Provider is entitled to unilaterally modify these General Terms of Use at any time by informing Users of the modification in the form of a short notice on the home page of the Service. If the User starts to use any part of the Service after the modification, this shall be considered as acceptance of the modification.
g) The Service Provider confirms that the specific provisions of the individual contract (subscription, order) concluded between the Service Provider and the User shall prevail in the legal relationship between them. In the event of a discrepancy between these general terms of use and the provisions of the individual contract on the same subject, the provisions of the individual contract shall prevail.
